As members of the Machinery Dealers National Association, we will
accept within 30 days from shipment any machinery and equipment sold with return privilege, freight prepaid, for refund of the purchase price if proven mechanically unsatisfactory; or repair at dealer's option. Machines sold at our advertised list prices typically qualify for this "30-day return privilege". A more complete statement follows:SHAMROCK MACHINERY COMPANY CONDITIONS OF SALE:
All quotations are subject to prior sale, immediate acceptance and change without notice. Although all information has been obtained from sources deemed reliable, Shamrock makes no warranty or guarantee, expressed or implied, as to the accuracy of the specifications herein contained. Specifications are approximate and should be used as a guide only. Buyer should inspect and verify specifications. All items are sold with NO EXPRESS OR IMPLIED WARRANTIES, whether with respect to FITNESS OF PURPOSE, MERCHANTABILITY, OR OTHERWISE except those, which are extended directly by the manufacturer. ALL WARRANTIES, IF ANY, BY A MANUFACTURER OR SUPPLIER OTHER THAN SHAMROCK MACHINERY COMPANY ARE THEIRS, NOT SHAMROCK'S, and only such manufacturer or other supplier shall be liable for performance under such warranties. Unless Shamrock furnishes Buyer with a separate written warranty or service contract made by Shamrock on its own behalf, Shamrock hereby disclaims all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose on all goods and services sold by Shamrock. Under no circumstances will seller be liable for any incidental or consequential damages or for any other loss, damages or expense of any kind including loss of profits, arising in connection with this contract or with the use of or the inability to use sellers products furnished under this contract. This equipment may not conform to federal safety codes nor the safety codes enacted by various states. Conformance is the responsibility of the buyer. Buyer agrees to save and hold harmless the seller from any and all liability connected with the above equipment. The machine, as priced, is AS IS, AS INSPECTED, WITH ALL FAULTS, WITH REMOVAL AT BUYERS RISK & EXPENSE, cash with order, unless otherwise indicated hereon. All transactions will be deemed made and governed by the laws of the State of Texas with payment due in Houston, Harris County, Texas. Shipping dates are approximate only and are subject to delays because of acts of God, or any other causes beyond our control. Any contrary clause contained in the customers purchase order shall NOT be considered as a part of the conditions of sale. This quotation is subject to the final Conditions of Sale set forth on Shamrocks invoice. Shamrock is not responsible for damages to equipment while in transit.
